Working with Cliodhna
A European Arrest Warrant is a surrender procedure between EU member states, and it cannot be executed in Israel. That gap matters: the issuing state has to convert its case into a treaty-based extradition request, and the conversion is where much of the defence lies. For clients with EU exposure, the questions are whether the mandatory or optional grounds for refusal apply, whether dual criminality is required for the offence in question, and whether proportionality has been addressed at all. Immigration consequences run alongside — removal, refusal of entry, and the status of any pending application — and treating them as a separate problem from the criminal one is how cases are lost. Where a client holds rights of residence in more than one state, the surrender question and the immigration question have to be answered together, since the outcome of one routinely determines the other.
